HENRY, Circuit Judge.

In this appeal, plaintiffs-appellants seek review of the district court’s dismissal of them 42 U.S.C. § 1983 action seeking declaratory and injunctive relief against defendants-appellees, Shawnee County District Attorney Joan Hamilton and the State of Kansas, Third Judicial District. The plaintiffs’ suit arises from nine state criminal prosecutions commenced against six of the plaintiffs in March 1995.
