BACKGROUND

Currently before the Court is the Motion for Partial Summary Judgment of Defendants Sea-Land Services, Inc. (“Sea-Land”) and S.S. Sea-Land Reliance against Plaintiff Edwin Y. Yballa.

Plaintiff Yballa is a resident of Hawaii and a former crew member and oiler aboard defendant Sea-Land’s cargo container ship, Sea-Land Producer.1 Yballa joined Sea-Land Producer on June 22,1994 in Honolulu.
