MEMORANDUM OPINION AND ORDER

This matter came up for bifurcated liability and damage trial during July and August of 1989. Plaintiff brings suit as as-signee of the claims of a failed state bank for attorney malpractice. Plaintiff alleged the Aurora Bank’s lawyers alleges negligently failed to uncover and stop an ongoing fraud perpetrated against the bank. At the conclusion of the liability phase of trial, the jury found defendants Glenn B. Clark, Jr. and Robert K.
