The plaintiff is, and has been for about 20 years, a contractor and builder in Houghton county. *457This suit was brought to recover a balance claimed to be due him from the defendant upon a building contract made in June, 1916. Plaintiff’s claim is concisely stated in the declaration to be that on or about June 14, 1916, he made the defendant a bid to excavate for a cellar and basement, and to furnish the labor and material for erecting a dwelling house and painting and decorating the same for $5,360.37, which said bid was made in writing and delivered to defendant; that after the receipt of…
