This is an action to recover damages for personal injuries. The plaintiff at the time of his injury, Oct. 31, 1890, was in the employ of James 37. Willard, Jr., lumber dealer, in the city of Albany, who was the proprietor of a yard upon which stood a mill for the cutting and dressing of lumber, situated some distance from the railroad of the defendant. A switch had been constructed from the railroad premises to the lumber yard, entering at the north end and extending its entire length parallel with the mill.
