Appeal, by permission, from an order of the County Court of Franklin County (Main, Jr., J.), entered September 5, 2006, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment convicting him of the crime of criminal sale of marihuana in the third degree.

Defendant was charged with, among other things, criminal sale of marihuana in the third degree and criminal possession of marihuana in the second degree.
