This was an application for a mandate, under article 48 of the code, (2 G. & H. 820, et seq.,) by tho appellant against the members of the common council of the city of Greencastle.

The affidavit on which the writ was asked states, that the city is incorporated under the general law; that the defendants áre the mayor and common council; that on the 28th of May, 1866, the common council made an order for the improvement of Seminary street; that the engineer of the city was directed to advertise for bids for the improvement ; that the engineer made out his specifications for the improvement;…
