INTRODUCTION

This case involves a dispute over a military personnel decision by the U.S. Department of the Army (“the Army” or “defendant”). The plaintiff, Stephen W. Richey (“Capt. Richey” or “plaintiff’), received an involuntary honorable discharge on April 1, 1996, after twice being passed over for promotion to the rank of Major from the rank of Captain, in 1994 and 1995, respectively.
