This action was brought to recover damages for personal injuries alleged to have been sustained by the plaintiff on November 4, 1921, “ by reason of falling into a hole in the sidewalk at West 85th Street, New York City, in front of premises known as 525 West End Avenue.” The pleadings were oral. The defendant pleaded a general denial. A statement indorsed on the back of the summons reads as follows: “ Statement of the nature and substance of plaintiff’s cause of action: For personal injuries sustained by plaintiff by reason of falling into a hole in the sidewalk at West 85th…
