Defendants General Cigar Holdings, Inc. (the legal successor in interest to named defendant Culbro Corporation) and General Cigar Co. Inc. (collectively “General Cigar”) have moved pursuant to Rule 56 of the Federal Rules of Civil Procedure for summary judgment to dismiss the complaint of plaintiff Emmpresa Cubana del Tabaco d.b.a. Cubatabaco (“Cubatabaco”) on the basis of estoppel, acquiescence, and laches due to Cubatabaco’s alleged long delay in challenging General Cigar’s use and registrations of the COHIBA trademark.
