— The action is brought for Benjamin E. Yeargan, a person non compos mentis, by his wife, his guardian, for damages for personal injury alleged to have been received on November 29, 1905, by him as resulting from the explosion of a valve, a part of the machinery about which he was working in the discharge of his duties as employe of defendant (the appellant), which valve and the machinery and pipes adjacent thereto defendant had negligently permitted to become old, worn and defective, so that the same had become unfit for use, and that defendant was negligent in having…
