Fox, Judge:
The plaintiff, Arthur Milam, seeking to recover from the defendants, Paul Settle and others, damages for an alleged conspiracy, and acts performed thereunder to his prejudice, instituted his action of trespass on the case, in the Circuit Court of Kanawha County. The summons in the action, returnable to August Rules, 1943, commands the Sheriff of said county to “summon Paul Settle, T. R. Pickett, Harry Settle, J. W. McCormick, Ernest King, Charlie Palmer, Tom Bonham, R. M. Hardiman, S.' R. Joyner, P. L. Peek, W. H. Ryan, George Carte, and others too numerous to mention, Members…
