—In an action to recover damages for personal injuries, the plaintiff appeals, as limited by his brief, from so *266much of an order of the Supreme Court, Queens County (Polizzi, J.), dated December 22, 1998, as granted that branch of the motion of the defendant Saxony Towers Realty Corp. which was for summary judgment dismissing the complaint insofar as asserted against it.

Ordered that the order is affirmed insofar as appealed from, with costs.
