On the night of November 19, 19'31, William Walker, a car inspector employed by the Nashville, Chattanooga & St. Louis Railway, was fatally injured by its switching engine while standing close to track No. 2 in its Cravens Yards in Chattanooga. His administrator recovered in this action a judgment for $5,000 upon the verdict of a jury under the Federal Employers’ Liability Act, as amended (45 U. S. C. A., sees. 51-59).
