Miller v. State
Texas Court of Appeals, 1st District (Houston)
1Opinion of the Court
OPINION
TERRY JENNINGS, Justice.
A jury found appellant, Leslie Lee Miller, guilty of the offense of murder 1 and assessed his punishment at confinement for 25 years. In five points of error, appellant contends that the trial court erred in denying his request to instruct the jury on the lesser offense of criminally negligent homicide, 2 the evidence was legally and factually insufficient to support the jury’s rejection of his claim of self-defense, and the trial court erred in denying his motion for new trial, which was based on his claim of ineffective assistance of counsel. We affirm.
