OPINION

BURNS, District Judge.

This action, challenging the location of the proposed Mt. Hood Freeway in Portland, Oregon, was originally commenced July 31, 1972. Plaintiffs asserted twelve claims, some of which were based on 42 U.S.C. § 1983. 1 On May 24, 1974,1 ruled in favor of plaintiffs on their eighth claim— that the state highway defendants had failed to comply with 23 U.S.C. § 128(a) and its implementing regulations.
