Appellant on December ¿4, 1901, filed his petition in the County Court of Tazewell County, for an order, requiring appellee to pay and deliver over certain funds and real and personal estate belonging to John J. Gerber, a non-resident lunatic, in the custody of appellee, and for the removal or discharge of said appellee as conservator of said lunatic. The petition was dismissed in the County Court for appellant’s failure to give securer for costs, and upon appellant’s appeal to the Circuit Court, the cause was there heard by the…
