WEINFELD, District Judge.

The plaintiffs, the President and the Secretary-Treasurer of the union individually, and the union bring this action on behalf of themselves and all other individuals and labor organizations similarly situated to restrain the operation and enforcement of § 8, Part III of the recently enacted Waterfront Commission Act of New York State, Laws of 1953, C. 882, § 8, on the ground of constitutional infirmities both under the Constitution of the United States and the Constitution of the State of New York.
