The question raised by this appeal concerns the effect of the settlement of a personal injury action and the release entered into as a result thereof upon the rights of the plaintiffs vis-a-vis their own insurance company under an “Additional Personal Injury Protection” indorsement to their policy of automobile liability insurance. We have concluded that the plaintiffs’ actions did not impair the subrogation rights of their insurer, and that they are therefore entitled to recover additional first-party benefits to reimburse them for extended economic loss…
