MEMORANDUM OF DECISION

RUSS KENDIG, Bankruptcy Judge.

This matter comes before the court upon a motion to dismiss pursuant to 11 U.S.C. § 707(b) of the United States Bankruptcy Code 1 filed by Saul Eisen, United States Trustee (hereafter “Trustee”). Brandon and Brenda Mooney (hereafter “Debtors”) responded and a hearing was held on June 7, 2004.

JURISDICTION

The court has jurisdiction over this matter pursuant to 28 U.S.C. § 1334(b) and the general order of reference entered in this district on July 16, 1984. This is a core proceeding under 28 U.S.C. § 157(b)(2)(0).
