— This is an action for fraud and deceit. Appellant purchased of respondents John and Aneonia Caleb about 40-acres of land and certain personal property for $12,000. He alleges that respondent John Caleb, in order to induce him to purchase the land, falsely and fraudulently represented to him that it was not subject to seepage; that he believed and relied upon said representation and purchased the land; that said land was subject to seepage to appellant’s damage in the sum of $5,000.
