This cause comes to this Court on the appeal of the defendants from the decree of the Court of Chancery Appeals. The controlling questions presented in the assignment of errors and argument before us are the same as those considered by that Court in an elaborate and able opinion delivered by Judge Neil. We refer to that opinion .for a statement and discussion of those questions. It is as follows: ‘ ‘ This bill was originally filed by E. L. Weakley and Mrs. Sarah C. Paige.
