Asa G. Candler Inc. brought suit against H. T. Hagan, in the municipal court of Atlanta, to recover rent alleged to be due on a certain lease or contract of rental. Briefly stated, the petition set forth the following contentions: On November 28, 1933, a contract (a copy of which is attached to the petition) was executed between Asa G. Candler Inc. and Food Shops Inc. This contract was executed on behalf of Food Shops Inc. by H. T. Hagan as president. .
