Defendant was tried and convicted of failure to file income tax returns for the years 1974 and 1975 in violation of 26 U.S.C. § 7203. At trial the government introduced proof that defendant filed a tax return for 1970, but not 1971 and 1972. A return for 1973 was filed after the investigation started. The government also introduced proof that defendant did not file timely income tax returns for the years 1976, 1977, and 1978.
