Appellant was arrested toy the city marshal of Batesville, 'brought ¡before the mayor, tried, and convicted on a charg’e of transporting liquor, and fined $100. His conviction was affirmed on-appeal to the circuit court.

The facts as disclosed by the marshal, the only witness in the case, are that the marshal saw appellant and “another fellow” walking along the street and go into Hardy & Sons’ livery barn.
