Plaintiff Nancy McLaughlin. owns the surface rights to a 143-acre tract of land in Ohio. Long before McLaughlin acquired the property, Consolidation Coal Company had severed the oil and gas rights. Seventeen years after McLaughlin bought the surface-rights, Consolidation conveyed its oil and gas rights to CNX Gas Company, LLC. McLaughlin then filed this, action to quiet title, alleging that Consolidation had abandoned its oil and gas rights under ■Ohio’s Dormant Mineral Act (ODMA) and that the oil and gas rights had therefore merged with McLaughlin’s surface…
