GARRETT, Chief Justice.
W. L. Moody & Co. brought suit in the District Court of Anderson County, October 30, 1889, against Martin Hinzie, by attachment for debt. The petition alleged, that on the 15th day of February 1889, the defendant executed and delivered to plaintiffs his two promissory notes in writing, in the first of which he promised on October 15, 1889, to pay to the order of plaintiffs the.sum of $2500, with 12 per cent interest from maturity, and 10 per cent in addition as attorney fees in the event the note was not paid at maturity and should be placed with an attorney for…
