OPINION ON STATE’S PETITION FOR DISCRETIONARY REVIEW

MILLER, Judge.

Appellant, Forest Leon Ethington, 1 was convicted by a jury of the offense of aggravated robbery. V.T.C.A. Penal Code, Sec. 29.03. The jury assessed punishment at life in the Texas Department of Corrections. 2 The Fort Worth Court of Appeals reversed and remanded in a published opinion, Ethington v.
