FAY, Circuit Judge:

The Spring and Summer of 1980 witnessed a mass exodus of Cuban refugees from Mariel Harbor to Key West, Florida in what has been designated the “Freedom Flotilla.” This appeal results from criminal charges brought against those responsible for transporting these aliens to the United States pursuant to 8 U.S.C. § 1324(a)(1). In a rare, but not unprecedented, procedure, the United States District Court for the Southern District of Florida sat en banc for argument on. the defendants’ motions to dismiss the indictments.
