This was a prosecution commenced by affidavit filed on October 22, 1921, in the Delaware Circuit Court charging that Robert Crabbs, “on or about the 22nd day of October, 1921, at and in the county of Delaware, State of Indiana, did then and *250there unlawfully keep and have in his possession intoxicating liquor, in violation of the laws of the State of Indiana.”
