Mrs. E. M. Cunningham purchased through the Land Board the section of school land in controversy, in the year 1884, under the Act of 1883, and actually settled thereon within six months, as provided in that act. She made this purchase and settlement for her own benefit, as well as for the benefit of her son and another person. That is, she testified that such was her intention, though there was no contract between them to that effect.
