This was an action of trespass to try title brought by appellant against appellee to recover possession of a tract of land described in the petition and damages alleged to have accrued from the destruction of timber upon the land and the construction of a railroad across it. The defendant company pleaded not guilty as to a strip of the land one hundred feet wide extending through the tract and disclaimed as to the remainder.
