Anthony Griffini appeals from a final order entered in the District Court 1 for the Eastern District of Missouri denying his petition for writ of habeas corpus. Griffini v. Purkett, No. 4:92CV343-DJS (E.D.Mo. Apr. 2, 1993) (judgment adopting recommendation of magistrate judge 2 ). For reversal, appellant argues the district court erred in finding that he failed to establish cause to excuse his procedural default and in adopting the magistrate judge’s report and recommendation without holding an evidentiary hearing.
