The plaintiffs in this action are the children of Byron G. Dodge, deceased, by his former wife, Annie Smart Dodge. It is their claim that the defendant Lillian Campbell, calling herself Mary Alexander Dodge, and who claims to be the widow of the decedent, was never lawfully married to him and is not entitled to any interest in the property of which he died seized, *646and they seek a declaratory judgment based upon this claim and the evidence given thereunder.
