The issue presented for determination in this proceeding is whether the respondent’s ward, an incompetent war veteran, was the husband of decedent and as such entitled to a distributive share in her estate. A hearing was had on that issue and the court rendered its decision (N. Y. L. J., June 3,1943, p. 2171, col. 6), wherein it held that a ceremonial marriage in 1917 between decedent and respondent’s ward was voidable *901and not void and that, upon all the evidence adduced, the respondent’s ward was the husband of decedent and entitled to a distributive share in her estate.
