The plaintiff was injured on the sidewalk in front of the store leased or maintained by the defendant. She testified that, as she was proceeding on the sidewalk through a path which had been cleared of ice and snow by employees of the defendant, one or more pedestrians approached her. The plaintiff declared that she moved to one side of the clearing in order to 'permit him or them to pass her. In doing so, she stepped upon the snow and ice which was banked upon the sidewalk alongside the cleared path.
