The defendant, Adolph Wyatt, was charged by information filed in the district court of Oklahoma county with the crime of attempted assault with a dangerous weapon; was tried, convicted by a jury who left the punishment to the court; the trial court thereupon sentenced the defendant to serve the maximum term of 2% years in the State Penitentiary, and he has appealed.
The state has filed a motion to dismiss the appeal on the ground that the petition in error with case-made attached was not filed with the clerk of this court within the six months fixed by statute, and, therefore, this court is…
