Under an information filedi in the district court of Choctaw county April 24, 1937, charging defendant, Easton Johnson, with the crime of rape in the first degree, alleged to have been committed in said county on or about the-day of August, 1936, on one Margaret Willis, a female person of the age of 12 years, and not the wife of tbe said Easton Johnson, be was tried and convicted, and in accordance with tbe verdict of tbe jury was sentenced to serve a term of 25 years’ imprisonment in tbe State Penitentiary.
