FENNER, District Judge.

Now before the Court are two cross motions for summary judgment. Plaintiff Dee Ella Lee (“Lee”) filed a motion for partial summary judgment asking the Court to find that the Defendant, Roderick Paige, Secretary of the United States Department of Education, (“Education”) has been improperly offsetting Lee’s Social Security benefits in order to collect on two student loans that are both over twenty years old.
