At the general election held in Morgan county, on Tuesday, the 10th day of October, 1876, the *303appellant and the appellee were opposing candidates for the office of treasurer of said county. On the Thursday following, being the 12th day of October, 1876, the board „of canvassers of said election, for said county, declared the appellant elected to said office of treasurer, by a majority of one vote over the appellee-.
