This writ of error was sued out by the plaintiff in the court below to an adverse judgment on defendant’s demurrer to plaintiff’s declaration.

The defendant was engaged in the general banking business in St. Petersburg, and the plaintiff had been a depositor and customer of "the bank for some six (6) years, and had conducted various business transactions by and through the defendant’s bank.
