The questions arise out of a wrongful death action against defendant Sterling Industrial Corporation (Sterling) based on a theory of products liability. The decedent, Robert N. Gelinas, was killed in the course of his employment with National Fence and Granite Company (National Fence) while operating a post-pounding machine manufactured by Sterling.
