Appeal from Circuit Court, Hughes County. Hon. LymaN T. Boucher, Judge. Harry Holborn appealed from a ’ conviction, and applies for return of the record to the trial court for a motion for new trial.

This is an application, upon due notice, for an order returning the record to the circuit court for the purpose of allowing the appellant to move therein for a new trial on the ground of newly discovered evidence. It appears from the record that appellant was convicted of grand larceny, and sentenced to imprisonment in the penitentiary for the term of two years, at the regular November, 1907, term of the circuit court within and for Hughes county; judgment having been entered on the 18th day of November, 1907.
