OPINION AND ORDER

NORGLE, District Judge:

Before the court is Plaintiffs’ Motion for Summary Judgment. For the following reasons, the motion is granted as to liability and denied as to damages.

Plaintiff NutraSweet Company and its parent company, Monsanto Company (collectively, “NutraSweet”), claim that Defendant X-L Engineering Corporation (“X-L”) and its president and majority owner, Paul Prikos 1 (“Prikos”), illegally “dumped” toxic chemicals which eventually migrated to, and polluted, NutraSweet’s land.
