Court of Appeals for the Fourth Circuit

1Opinion of the Court

CHAPMAN, Circuit Judge:

The sole issue in this appeal is whether the district court erred in dismissing under Federal Rules of Civil Procedure 12(b)(6) a cause of action in which plaintiff alleged that his wife had willfully intercepted and recorded his telephone conversations in violation of Title III of the Omnibus Crime Control and Safe Streets Act of 1968 (Title III). 18 U.S.C. §§ 2510-2520. Because we find that the language of the statute is not susceptible to the engrafting of an inter-spousal exception, we reverse the judgment of the district court and remand the case.
