This case involves an appeal from a final judgment in the Court of Common Pleas of Lucas County, in an action for a declaratory judgment, brought by the Toledo Trust Company as trustee of an inter vivos trust created by James Gerity of Adrian, Michigan. The action was brought to determine the validity and/or legal effect of the purported exercise of a power of appointment by defendant National Bank of Detroit, the appellant herein, as guardian of Virginia B.
