The defendant wrote the plaintiff the following letter: “Confirming my conversation of the 25th inst., with your Mr. A. J. Fink regarding the selling of my property, I think you might proceed and sell the entire thirteen (13) houses separately for Fifty Thousand ($50,000.00) Dollars net cash. Your commission of 3% to come out of the last sale made.” The houses Avere sold for the aggregate of $50,000.00.
