This was a proceeding in the nature of a quo warranto, instituted in the Circuit Court of Alexander county, requiring appellee to show by what authority he collects tolls and tonage duties of, and controls the anchoring of vessels lying in the harbor of the city of Cairo. Appellant pleaded four several pleas. First, denying that he did exercise the office of wharf-master, nor did he use and enjoy the liberties, privileges and franchises in the manner and form as laid to his charge, and concludes to the country.
