MEMORANDUM OPINION
ACKER, District Judge.
This cause, as to one of the several defendants, Speedway Oil Company, Inc., (Speedway), has been submitted on that defendant’s motion for summary judgment. The Court has carefully read and considered the briefs and has heard oral argument on the motion filed by Speedway, which said motion the Court deems re-interposed to the amended complaint after the Court allowed plaintiff, CPI Oil & Refining Inc.
