GLASSER, District Judge.
Plaintiff Ammcon, Inc. (“Ammcon”) was the general contractor on a housing project located at 224-246 Kingston Avenue, Brooklyn, New York, the David Chavis Apartments, to provide housing for elderly persons. The First Baptist Church of Crown Heights Senior Citizens Housing Development Fund Corporation (“First Baptist”), an assetless, not-for-profit corporation, sponsored that housing project and owned the property upon which it was to be built.
